Will 'cronyism' allegations re-emerge after new Brent Council appointment?

I heard yesterday that Lorraine Langham had been offered one of the newly created Corporate Management Team jobs at Brent Council after interview.  The job of Chief Operating Officer is part of the senior management restructuring carried out by Christine Gilbert and Cara Davani. It is a one year fixed term appointment at salary of £125-142k. LINK

The restructuring saw the departure, with compensation, of Fiona Ledden, Head of Legal and Procurement and Ben Spinks, Assistant Chief Executive Officer, over the Christmas holiday.

I sought confirmation of the appointment from Brent Council press office at 9.30am this morning but they have still not got back to me at 2,15pm. However, I do think the appointment, if it has been made, is important background to the deliberations of the General Purposes Committee which will be discussing Michael Pavey's HR review at 6pm this evening.

Lorraine Langham, like several of the present CMT, has previouslly worked for Tower Hamlets Council and Ofsted. (See table below). Like Gilbert and Davani she also has her own private company. She is no stranger to controversy over her alleged friendship with Christine Gilbert as this hit the headlines in 2007 and again in February last year. LINK

The Daily Express reported:
In 2006 the wife of Labour minister Tony McNulty, Christine Gilbert, was appointed as Chief Inspector of Schools at the watchdog.

Within a year, Ms Gilbert had appointed a number of former colleagues to key positions within Ofsted.

Ms Gilbert - the former chief executive of Tower Hamlets council - recruited her friend Lorraine Langham to be Ofsted's £120,000-a-year director of corporate services.

Ms Langham had worked for Ms Gilbert at Tower Hamlets as communications chief through a company she ran called Verve Communications.

That company was paid £923,000 from Tower Hamlets over a two-year period.

The then-MP for Bethnal Green and Bow, George Galloway, said at the time:  "You have a situation where this woman is a propagandist for probably the worst council in Britain and, lo and behold, she gets a job with her best pal.

"There is not a whiff of cronyism, there is a stench of cronyism.

"You would have thought Labour would have learned something but, clearly, they believe they are above scrutiny."

Ms Gilbert and Ofsted denied the allegation at the time, saying Ms Langham had been appointed after a thorough and transparent recruitment process.

Ms Langham remains Ofsted’s chief operating officer.
I am sure that this was also a 'thorough and transparent recruitment process' and that Brent HR made sure any connections and associations were declared.

Tony McNulty is a Labour Party activist working hard for a Labour General Election victory in Brent and Christine Gilbert is Brent's neutral Returning Officer.

Seething behind the scenes at Brent Council's meeting tonight

The format of Brent Council meetings these days is pretty predictable.  LINK The Leader makes a speech extolling the virtues of Labour members, outlines the difficult conditions caused by Coalition cuts and berates the opposition and then reaffirms the administration's commitment to protecting the vulnerable. Often adding that none of us became councillors to make cuts but we have to obey the law'.

The Tories refer to the mess left by Labour, wastefulness of the Council and go on about parking charges.

Questions to Cabinet members now have to be sent in advance so answers are carefully crafted. Backbench councillors ask prepared questions (often read out in stilted fashion) to Cabinet members that enable the latter to preen themselves and boast of their achievements with the opportunity for an additional swipe at the opposition.

Towards the end of the meeting Motions are put by Labour, Conservative Officials (Kenton) and Conservative Provisionals (Brondesbury Park). There's some Punch and Judy exchanges with the lone Lib Dem councillor looking a little lost; and then the Labour motion is approved and the Conservative motions defeated.

The unpredictability lies mainly with the voting of the Conservative groups and whether the Officials support the Provisionals or remain loyal to the Labour Group who granted them official status.

Tonight Cllr John Warren is moving a motion that regrets the fact that Standing Order changes mean that they cannot propose a vote of 'No Confidence' in Councillor Butt.

Warren will not have endeared himself to the Kenton councillors with the tweet he sent out in the early hours this morning:


 Kenton Conservative Councillor Bhiku M Patel died recently while on holiday in India.

Hardly tasteful tweeting.

Underneath all this there are real issues that could be raised. One is an update on the progress of appointing a new Chief Executive Officer. The Minutes of the September 2014 meeting record:


The Leader referred to the decision taken in June 2013 regarding the appointment of a new Chief Executive.  He stated that the external auditors were reporting back on how the Council was operating and whilst there was progress being made, stability within the Council would enable further progress to be made.  The current arrangements would therefore remain in place until a recruitment process began in the new year which would tie in with the launch of the new Borough Plan.
There has been little sign of any recruitment process and it now looks as if there may be an argument that Christine Gilbert should stay on until after the General Election because of her role as Returning Officer.  The fact that her partner Tony McNulty is actively campaigning for a Labour victory in Brent is not seen as a conflict of interest.

Another issue is of course that around the Employment Tribunal case and the finding that Brent Council racially discriminated against a council worker, victimised her and constructively dismissed her. Christine Gilbert will not countenance any disciplinary move against Cara Davani who was the second respondent in the case. Cara Davani, head of Human Resources. Cara Davani drew up Christine Gilbert's contract when she replaced Gareth Daniel  as Acting CEO, that included payment into her private company Christine Gilbert Associates. At the time Davbani wa sbeing paid a daily fee of £700 into her private company.

It would be interesting to have an update from Cllr Michael Pavey, Deputy Leader, on his internal review of Human Resources policies and processes. Two issues came up during the debate about his review including whether workers would have confidence that there would be no retribution over what they said and whether they could communicate with councillors over their concerns.

In Item 13 (Constitutional Amendment) a new clause has been added:


So Councillors approached by workers with concerns about racial discrimination, victimisation or constructive dismissal have to report them to Cara Davani, Head of Human Resources, who was the second respondent in a case where Brent Council was found to have racially discriminated against an employee who was victimised and constructively dismissed.  Cara Davani will be managing the redundancies consequent on the latest round of cuts.

Cara Davani is of course leading on the senior management restructure which has seen packages agreed for Fiona Ledden (former head of Legal and Procurement) and Ben Spinks (former Assistant Chief Executive Officer who was only appointed in 2013).

I understand that there has been one slight change in Gilbert and Davani's proposals. The original consultation ring-fenced the post of a senior legal officer to replace Ledden. Cara Davani's partner, Andy Potts,  was one of three employees thus eligible for the post. It was the only ring-fenced post in the whole reorganisation. Now the post will not be ring-fenced but only advertised internally. This seems to make little real difference in terms of who might be qualified for the post, so may just be a cosmetic change.

The Labour Group has its own internal tensions and a Labour councillor recently suggested to me that Muhammed Butt's support had declined to about 50% of the group against 75% a few weeks ago. It does not seem to be political opposition so much as distrust following recent machinations.


In the same week Pavey's Review will be put before the General Purposes Committee.

The Cooperative Party has nominated Sabina Khan and Tony McNulty.

Obama, Cameron and HMRC take their hats off to our Dawn


I met a Brent Labour Party member on Saturday who was having to build an extension to house all the communications from candidates for the nomination for Brent Central parliamentary - OK, a bit of an exaggeration, but the contest is predicted to increase recycling rates in the borough significantly.

Several candidates have put up campaign blogs including ex-Brent South MP Dawn Butler. LINK

She is the only candidate to boast testimonials from Barack Obama, Gordon Brown, Rev Jesse Jackson, David Cameron, The Metro and Her Majesty's Revenue and Customs amongst many others.  It is going to be hard for Tony McNulty to match that!

She states:
Taken as a whole, I believe nobody else matches my combination of: a Brent resident, an experienced MP for the area, my track record of local engagement, community contacts, working with local party members and a tireless campaigner both during and after elections.
Amongst the photos on the blog header (see above) is one for the Brent Fightback banner. It will be interesting to see of she shares Fightback's views on fighting Coalition AND local council cuts.

'Benefit thieves' ex-Labour MP launches his campaign for Brent Central nomination

Veteran Labour politician and former government minister Tony McNulty has launched his campaign for  nomination as Labour candidate for the Brent Central seat.

McNulty was Minister for London and Minister of State for Employment and Welfare Reform before having to resign over an expenses claim. He was asked to apologise to the House of Commons and repay £13,837.  The press drew attention to his perceived hypocrisy over his attack on benefit 'cheats' when he had said:
Benefit thieves have to understand that they will not get away with it. Working together with local authorities and the police we have a range of powers to investigate and with the support of the public we bring benefit thieves to justice.
 He lost his Harrow East seat to Bob Blackman at the 2010 General Election.

He is married to Christine Gilbert, Acting Chief Executive of Brent Council,  who was herself embroiled in controversy when it was revealed that her Council salary was paid to her own private company.  The Council recently extended her position until after the 2014 local election.

McNulty has been out regularly on the 'Labour doorstep' with other Brent Labour Party activists and has now sent this message to Labour Party members:



Dear Member,

Brent Central is about to embark on its selection of a parliamentary candidate and I have already written to you explaining why I am seeking the privilege of representing you in 2015. You should receive my leaflet in the next day or so. This is a hugely important selection in a seat that is crucial to the return of a Labour government. Brent Central deserves so much more than another Liberal Democrat MP propping up another disastrous Tory-led coalition.
 

My passion for the Labour Party is supported by my passion for Brent. I know Brent well with roots in the area that go back many years. Christine Gilbert confirmed as Brent Interim Chief Executive for another year

Brent Council last night approved the extension of Christine Gilbert's appointment as Interim Chief Executive until after the elections in May 2014.  See my previous story LINK

The move was opposed by Paul Lorber, leader of the Liberal Democrat opposition, who said that there was no reason why the appointment of a new CEO should not be made not. He declared that he did not accept the reasoning behind the officer's report which argued that a delay would provide stability and safeguarding of the Council's reputation over the period of the move to the Civic Centre and the May 2014 local elections.

He said that the interim appointment had been made by officers in consultation with the Leader of the Council and that members should be fully involved if a candidate capable of working with any prospective leader were to be appointed. He also said that the new post holder should be on the council's payroll rather than have his or her salary paid into a private company.

Labour's majority, assisted by the vote of Barry Cheese who appears to be a semi-detached Lib Dem at present, ensured that Christine Gilbert, wife of ex-Labour MP and Minister Tony McNulty ensured kept her Brent job along with her second job with Haringey Council.

Tony McNulty gives a helping hand to Brent Labour

There was an interesting tweet from Cllr Krupesh Hirani yesterday when he was out campaigning for Labour in Dudden Hill ward.

Tony McNulty is the former Labour MP for Harrow East who resigned his ministerial position after  allegations that he claimed expenses for a second home, occupied by his parents, which was only 8 miles away from his primary residence. As a minister McNulty had said, 'We are absolutely determined to stop benefit thieves stealing from the British taxpayer.'

McNulty is married to Christine Gilbert, Interim Chief Executive of Brent Council. Gilbert's arrangement for her salary to be paid into her private company Christine Gilbert Associates LINK though legal, have come in for criticism.

Yesterday I blogged that  a report by Fiona Ledden, to be considered by full council, recommends that the permanent Chief Executive post is not advertised until after the 2014 Council Elections.

One of the stated reasons is:
Council will be aware that there will be an election in the Borough in May 2014 when all Council seats will be up for election and this is clearly an important matter for the authority not only in terms of operational management but also in relation to reputation management. The continuance of the current interim arrangements will ensure that the overall planning and management for that election can be organised and properly overseen by an interim Chief Executive who has developed a full understanding of the organisation.
It is reassuring that so much trouble is being taken to protect the reputation of the council.

Former Ofsted chief takes over as Acting Brent Chief Executive

With amazing timing Brent Council has announced, on the eve of the Brent Education Debate (Copland High School, Wembley 7pm tomorrow), that it has appointed Christine Gilbert former Ofsted Chief Inspector, as Acting Chief Executive. Before that she was the Chief Executive of Tower Hanmets.  She is expected to start in November and will remain in post until the permanent new Chief  Executive is appointed, which could take several months.

This is what the Guardian said about her soon after she moved from Ofsted when Michael Gove became Secretary of State for Education:
A shy media performer, Gilbert is known for being tough on schools. She triggered controversy with headteachers by raising the bar for inspections, insisting that a "satisfactory" grading would no longer be enough and that all schools should be aiming to be rated at least "good", if not "outstanding".
Ofsted inspection results have improved steadily over the period. Most recently, she claimed that too many lessons in English schools are still "dull and inspiring".
She was heavily criticised over Ofsted's role in the inspection of Haringey council during the period when Peter Connolly – known as Baby P – was killed. She admitted failings in the inspection system that rated the council "good" during that period, though insisted she was already reforming the system.
There were suggestions that Gilbert was seen as too close to the previous Labour government. A headteacher by the age of 32, she was head of education at Tower Hamlets, where she dramatically improved schools, before being appointed to Ofsted in 2006. She is married to the former Labour minister Tony McNulty.
McNulty lost his Harrow East seat at the 2010 election. He resigned from his government position earlier after press allegations over his expenses.

Muhammed Butt announcing the appointment said:
I am delighted that Christine has agreed to accept the post. She has a wealth of local government experience at the most senior level and will provide inspirational leadership to the council in the months ahead.

Brent is proud of its achievements to date and although already a high performing organisation we are committed to providing even better services to residents under the Council's new leadership team. Residents can expect to see a range of exciting transformations in the quality of services we provide to the local community.
Gilbert is likely to have a major influence on the 2012-13 budget which will include more cuts to local services as well as a possible 2.5% rise in Council Tax.

Harrow Students Debate the Big Issues

I had a great time last week at a Question Time style hustings at Harrow College.  I was pitched against Bob Blackman, Conservative (who will resign as Conservative leader of Brent Council AFTER the election); Tony McNulty, Labour; Fred Leplatt, Respect; and Nahid Boethe (Lib Dem). There was a lively audience of 80-100 mainly first-time voters who questioned us on the economy, capitalism and climate change, Afghanistan, BNP, tuition fees and black and asian political leadership. 


Students were asked about their voting intentions before and after the debate. The results were encouraging. Voting intention before the debate in brackets:

Conservative 18% (20%)
Labour 23% (25%)
Liberal Democrat 9% (7%)
Green 23% (9%)
Respect 11%
Other 5% (9%)
Not voting – 7% (18%)
Don’t Know – 3.5% (9%)

The most important issues for the students, listed in order of priority, were: Education, HE Fees, Afghanistan and the Economy.
