Fryent Murders: Official statement from Metropolitan Police on 'inappropriate' photographs & Met's response to missing persons reports

On Wednesday, 17 June the MPS’s Directorate of Professional Standards was informed of allegations that non-official and inappropriate photographs had been taken by police at the crime scene in place in Fryent Gardens, Wembley in relation to the murders of Bibaa Henry and Nicole Smallman.

The MPS made a referral to the Independent Office for Police Conduct which has launched an independent investigation.

Two MPS officers were arrested on Monday, 22 June by the IOPC on suspicion of misconduct in public office. They have since been bailed to return pending further enquiries.
Both officers – who are based on the North East Command – have been suspended from duty.

These are very serious allegations and the MPS has been and will continue to provide every possible support to the IOPC investigation team as they work to establish the facts.

Commander Paul Brogden said:

 “I am horrified and disgusted by the nature of these allegations; a sentiment which will be shared by colleagues throughout the organisation. If true, these actions are morally reprehensible and anyone involved will be robustly dealt with. I am limited in terms of being able to comment further about the matter at this time in order not to compromise the IOPC investigation.

“Senior representatives from the MPS and the IOPC visited the parents of Bibaa and Nicole to inform them of these serious allegations and confirm that it is now subject to an independent investigation with full co-operation from the MPS. This deeply disturbing information will no doubt have created additional trauma for a family who are already grieving the devastating loss of two loved ones. I can only start to imagine the impact of this; and I’d like to sincerely apologise to them for this further burden.

“I know that the wider community will share our shock and repulsion at these allegations and whilst our focus remains with Bibaa and Nicole’s family we are also listening to the concerns our communities and key stakeholders will want to raise about these allegations.”

Detectives investigating the murders believe that Bibaa and Nicole were killed in the early hours of Saturday 6 June. Later that day, they were reported as missing to police when they did not return home. Their bodies were discovered on Sunday 7 June.

As a result of their murder, a mandatory referral was made to the IOPC by officers from the DPS to consider the actions of police between the time a number of reports were made to police by family and friends that Bibaa and Nicole were missing and the time they were found. The IOPC have taken the decision to independently investigate, and the MPS is providing full support to that investigation.

Brent set to approve new primary school next to busy road despite air pollution warnings

Less than two weeks after Brent Clean Air warned about the need for urgent action to protect children from air pollution in schools site next to busy roads LINK, Brent Planning Committee will be considering building a 630 pupil primary school and nursery on the car park of York House, next to busy (and likely to be busier as Wembley continues to expand through regeneration) Empire Way, close to Wembley Stadium Station.  Traffic is already far busier than the artist's impression above, and busier at school times than shown in my photograph.

However, the Officer's report for the Committee LINK  does not go into any detail about air pollution, referring instead to a far more general reference back in 2015 when outline planning permission was given and focusing on the impact of demolition and construction rather than children's daily exposure to pollution.


They suggest that the playground will be protected from air pollution by the school building, although a rooftop multi use games area (MUGA) is planned as well as a rooftop learning area.  The playground itself is very small for a 630 pupil school.

There is an acknowledgement that the area has heavy traffic as the report proposes that there should be reserved parking for parents at the red multi-storey car park near the LDO which would be a dropping off point for the children. Entry to York House itself will be via the LDO.

The school will be run by Ark as goverment policy does not allow local authorities to build new schools, and anyway Brent Council leader, Muhammed Butt,  who attended the February consultation meeting about the plans, is a great fan of Ark. and sits on the governing body of Ark Elvin which is round the corner from the proposed school. Others in Brent Labour Party are critics of the whole academies programme. Putting that aside there is no discussion on whether a school of that size is required as the recent pupil census showed spare places in Brent Primary schools LINK and there may be a further reduction as a consequence of Brexit.  Of course new flats are going up at a pace around Wembley stadium but they are not being designed, or marketed, as accommodation for families.

Quite a test for the scrutiny powers of the new Planning Committee.

ARK want the old Barnet football ground at Underhill, for a computer-based learning system which reduces the need for teachers so the academy chain makes savings by staffing cuts and supersize classrooms. 

Blended learning technology was commissioned by venture capitalists in the USA who hope to see ARK trial it in a London school. 

Is this what we want for our young people and staff?
  • Residents are seriously concerned about the narrow, bendy, country roads around Barnet Lane and Mays Lane which become congested as it is.
  • Two large secondary schools opposite each other is unwelcome. The Totteridge Academy is rapidly improving and is linked to the community.

Why sell our Greenbelt? 
  • Barnet Council sold our Greenbelt land, to Tony Kleanthous, of Barnet Football Club for the price of a basic car - 14 years ago.
Government Education Dept. paid Tony £14.2 Million to buy it!

  • Why was public money spent before planning permission was granted and at a time when existing schools are suffering cuts and have had cuts year on year, to their education budgets?

  • Now ARK Pioneer propose to change the roads to two lanes which overall is unlikely to help and costs Millions from the Education budget and Barnet Council will have to pay almost half of the costs. Is this what local residents want? Is this best for our Borough?

 The Council are proclaiming a need for more school places but this is related to the whole Borough in the future.

There is no need for a new school in Underhill and the seven surrounding Wards.

Over the whole borough, several schools have spare places, including Bishop Douglas and Christ College in Finchley as well as Whitefields and others.
 
Saracens have land and will shortly open through school in Mill Hill/Colindale area.

The Totteridge Academy last year raised exam results by 20% so that 67% of pupils got 5 A - C grades. But this school needs continued support NOT competition from ARK pioneer.

The Borough of Barnet has 10 academy companies currently. Most are small and some have excellent policies. But Ark are so powerful it will greatly distort and damage current and future relationships between schools and the Council.

Let us know if you want info regarding how ARK plough extra private funding currently into some of their Ark schools to raise exam results. Additionally exclusions are higher than usual in Ark schools. 

But Ark Pioneer is not related to extra private funds but starts a trend towards fewer teachers and the disruption of classroom structure..

Surely, Barnet would  be better off without an 11th Academy Company.

Figures put need for new Ark primary academy in doubt

Consultation takes place Thursday morning and evening at Ark Wembley on their plans for a new 630 pupil primary school at the junction of Empire Way and the Royal Route LINK

New light is thrown on the proposal by figures obtained by FoI request for the number of vacancies in Reception for September 2017.

The figures show that some of the recently expanded schools are not filling up. A number of these expansions have involved controversy including Stonebridge (closure of the adventure playground) and Byron Court (vociferous opposition from residents).

The figures in the final waiting list column represent children who will have a school place in Septepmber but not their parents' first choice. Parents will waiting for a vacancy to arise to place them in the school of their choice, perhaps to join siblings or because it is more convenient for transport. Children can be on several waiting lists so the figures are of limited value.

When a school has vacant spaces and no waiting list the parents of children moving into the borough between now and September will be offered places there, which may involve a journey across the borough.

When children settle into a school, albeit not their first choice, make friends and settle into the routine, the parents desire for transfer is sometimes reduced: 'She is doing well, I dont think I want to move her now'

The 'churn' of pupils moving between schools creates instability and affects progress and achievement.  A new school could have a destabilising effect on other esrtablished local schools.

A considerable amount of money has been invested in the expansion of schools. If they are not filling up the additional places then there is a question of value for money.

School places planning and school expansion seems a ripe topic for s Scrutiny Committeee investigation.

Ark plan new primary school in Wembley but is it needed?


Ark appears to be about to expand its schools empire in Brent adding a new primary free school at Wembley Ark, Ark Elvin and Ark Franklin Primary.

The new school would be on a site at the corner of Empire Way/Wembley Hill Road and the Royal Route with a form entry of 90 (3 classes in each year group) making a total when it is full of 630 pupils with perhaps a 60 place nursery.

The Ark Somerville Primary School would be on a busy main road which is of concern given the impact of air pollution on children and it will be important to see how much open play space will be available to the pupils.

The most important concern though is whether a new school, and such a large one, is actually required. In the immediate vicinity of the proposed school are Elsley Primary which is currently doubling in size to four forms of entry, Park Lane Primary, Oakington Manor Primary and Wembley Primary.

An important factor is the impact of Brexit and the declining value of the pound in the number of European citizens working in Brent.  There is anecdotal evidence of a reduction in numbers which affects the number of  EU pupils in local schools. Alongside this is the continuing issue of families affected by the benefit cap being forced to move out of London.

Quintain is of course building new housing in the area but this is generally not affordable to local people and unlikely to accommodate families. Brent Council will need to provide robust projections of future demand to justify a new school.

I understand that several of the primary schools that have been expanded recently are not attracting sufficient pupils to fill the new places and that some may apply to reduce their form of entry.  I am awaiting the outcome of an FoI request to see the evidence on unfilled vacancies and waiting lists.

If there is not an overall increase in demand a new school would create a 'churn' of pupil movement as parents move their children between schools. Brent Council is committed to supporting 'parent choice' by running schools with some spare capacity but the downside of this is that pupil mobility can be disruptive to the continuity of learning and undermine pupil progress. Schools with high mobility may find it very hard to meet the target thresholds set by the government for Year 6 children when perhaps only 20% of them attended the schoool in Year 2.

Local public transport is already under strain with pupils from Ark Elvin, Wembley Ark, Michaela, Preston Manor and the Lycee converging at home time and the proposed new primary would be on the same routes although one would hope that they lived within walking distance of the school.

In September 2014 Ark submitted a free school application to the Department for Education to open a new primary academy in Wembley to help meet the growing demand for school places.

Following the approval of the application, Ark is now consulting on the proposal to open Ark Somerville Primary Academy, serving 2-11 year olds in Brent. It is proposed that Ark Somerville would open in September 2019 and admit 90 Reception age children each year until it reached its full capacity of 630 in September 2025; there is the potential that the school’s 60 FTE nursery might also open at the same time.

Ark Somerville will be located on the corner of Royal Route and Empire Way, next to the London Designer Outlet and will be a newly constructed building completed ready for September 2019 opening. The building is being designed and built by Bowmer and Kirkland, who will lead on a planning consultation later in the summer.

Ark Somerville Primary will be non-denominational, non-selective and mixed, serving local children. The admissions criteria will prioritise those living closest to the school. The school will have particularly strong links with Ark Academy (an all-through school), Ark Elvin Academy (a secondary school) and Ark Franklin Primary, all located in Brent. Ark Somerville will also become part of the wider Brent family of schools.

Staff and parents press for secret ballot on Furness academisation

Parents and staff from Furness Primary School, Harlesden, London gathered[1] to voice their deep concerns as to why their school was proposed to be turned into an academy. The Governors of Furness and Oakington Manor, federated schools, have made an application to turn the two schools into a sponsored academy trust without having first consulted parents and staff.

The question asked by everyone at the meeting was why? Furness school received a good rating by Ofsted in June this year. Oakington is currently rated as outstanding. The two schools federated three years ago to prevent Furness (which was then in special measures) closing or being taken over by an academy chain such as ARK.

The audience listened to Bridget Chapman, Chair of the Anti Academies Alliance, explain what academisation was all about – privatisation of state education and ultimately schools to be run for profit. She spoke about the evidence from research that showed that 13% of sponsored academies were classed as failing yet on 3% of state schools were in this Ofsted category. Further, the data shows a higher rate of exclusion among black and minority ethnic children in academies and there are fewer children with special educational needs. 99 academies had received warnings from the DfE about their financial dealing and 11 academy chains had received multiple warnings. The percentage of primary schools that have become academies is still very small and many of those have been forced to by the DfE despite there being no evidence that academies improve education for children, in fact the opposite.  Analysis of primary school results indicates that academy conversion actually slows progress” (Local Schools Network research).

Jean Roberts spoke on behalf of the education unions and told the audience how the unions had been stopped from making any presentation to staff at the so called consultation meetings held at both schools the previous week, as to why the education unions are united against the proposal. Staff who wanted to hear them, were shushed and told to be quiet by Mr Jhally, Chair of Governors of the Federation, when they protested. A motion of support for a campaign against the academy which had been passed by the Kensal Green Labour Party group was read out to much applause.

Mrs Libson who is the Executive headteacher of the federated schools had told the staff consultation meetings it was because Brent had done “nothing for the schools”. Brent LA dispute this most strongly. Jean Roberts had been sent a copy of the Brent Audit Report for Oakington Manor in June 2015. Auditors were unable to say that its accounts and accounting procedures were fully in order[2]. The report stated, “The key areas of weaknesses related to high value expenditure, income administration, stock management and pension administration”. One of the criteria Ofsted inspects in schools is the Governors oversight of school finances.

Janice Long a local councillor, who sent a message of support for the campaign against an academy, asked if the imminent Ofsted may be a reason for this rushed application.

Euton Stewart from GMB explained that in his experience the support staff were the first to be made redundant in academies. Academies can employ unqualified teachers, another concern of the teaching staff there. Parents spoke about the good teachers and the education they provided for their children at Furness and how all this change was unnecessary now the school had been given a good by Ofsted.

There was a clear commitment to continue to seek a secret ballot for parents and staff so that the Governors would fully know their views. Parents will continue to collect signatures on the petition. Staff are looking to hold meetings to discuss what they will do in response.

R.I.P COPLAND COMMUNITY SCHOOL 1952- 2014

Richard Marshall, the interim Copland Head hired by the Gove/ Pavey/IEB coalition to do their dirty work for them, this week  gave a new meaning to the much-abused word ‘professional’ when, in his last-day-of-term address to staff (and his first official recognition that any member of staff had left the school all year) he used it to describe the manner in which staff at Copland had responded to the one hundred and thirty three redundancies he had diligently imposed on the school since last July. By ‘professional’, Mr Marshall presumably meant that his sackings had been achieved without loss of life and, ultimately, with a kind of cowed resignation from the staff. In George Osborne’s  would-be-macho world of balding male willy-wagglers, where’ tough’ decisions have to be made with a fearless lack of concern for the comfort or security of any individuals (except themselves), this version of ‘professionalism’  can be framed as some kind of brave and realistic acceptance of the unavoidable new realities. 
                                                   
The inconvenient truth, however, is that Copland staff did not behave at all in the manner which management clones mean when they employ the weasel word ‘professional’  to mean ‘that of which I approve’.  In reality, Copland teachers  used their collegiate solidarity to resist at every stage what Richard Marshall and his sidekick  Nick John had been hired to do. When the pair arrived last July and demanded of Copland Heads of Department that they nominate people they wanted sacked, apart from the odd shameful exception they refused to do so. When the Heads of Department were then threatened that they themselves would go unless they provided names, they still refused. That resistance, an expression of the self-confident autonomous decision-making which is the mark of real professionalism, set the tone which continued throughout the year. Teachers at all levels (except senior management, inevitably) have been united in their action against the surrendering of the school to Ark Inc and its removal from local democratic accountability.   In the end, the fight was lost, as any fight by a few hundred teachers, parents and pupils  against Cameron plus Gove plus their friends on Brent Council plus a hand-picked and craven IEB plus a couple of hired ‘tough’ guys was always going to be lost. 
However, there are defeats and there are defeats.  Ark and the spivs who own it have grabbed Copland. They will give it a new name and claim the credit for the new  building (which, in fact, was planned to go ahead whoever ran the school).  But Gove has gone from the DfE and, as a result of his perceived ‘toxicity’ in the eyes of the electorate (in large part a result of the loud and active resistance of teachers like those at Copland) his hopes of leading the Tory party, and God help us, the country, have gone too.  
Copland staff can feel  proud of the fight they put up in defence of the jobs of their colleagues (including dinner ladies, classroom assistants, mentors, support staff, sports coaches, caretakers, cleaners as well as classroom teachers).  Their professionalism was manifested in action not in apathetic quiescence and  this kind of professional engagement and concern  is a crucially important part of the checks and balances in any democratic society’s resistance to a bullying centralised state. 
So ‘professional’ is certainly what the great majority of Copland staff have been, particularly in face of the despondency and disillusionment which they inevitably felt as they watched their various ‘Leaders’ abandon them. But to use the word ‘professional’ in the way Mr Marshall used it on Wednesday was an insult.  However, there is another variant of ‘professional’’s  many shades of meaning  and it relates to an any activity performed primarily for financial gain. At this point the word almost takes on the meaning of ‘mercenary’, where any moral qualms on the part of the people hired to carry out the activity can be silenced by, to misquote a great British politician of the past, ‘stuffing their mouths with ten pound notes’. There were  people in the hall at Copland on Wednesday who maybe were worthy of such an appellation; but it was certainly not those teachers and ex-teachers who were having to listen to that ill-judged  speech.

Congratulations to all the staff, parents and pupils who fought so hard and persistently to prevent forced academisation. Although you didn't succeed it was a battle worth fighting and an example and inspiration to others.

Copland: Did Premature Ejaculation Rule Out Final Ofsted Visit?

For those who like closure in their stories these are frustrating times. With only 2 weeks of the school year left it has been announced that, due to illness, Copland’s final Ofsted inspection visit will not now take place. This will mean that the HMI’s  written report of the visit may have to be put back on the shelf for a while. This is quite unnecessary, however, as the 3 reports published after earlier visits this year indicated that the actual inspections had little influence on the final reports,  the content and assertions of which were overwhelmingly determined by the DfE/Ofsted’s pre-written narrative of which the reports simply formed a  part. The nature of the narrative arc was set in the first Ofsted report this year (‘the interim headteacher and associate headteacher and very strong governance of the IEB are driving change well’) and it soon became clear that the reports’ principle purpose was to portray  the ‘saving’ of a school by Gove, his ‘useful idiots’ Pavey, Marshall, John, Price and the rest of the IEB, through  forced academisation, ‘tough’ but necessary action, (60 staff and half the curriculum axed), and finally the salvation that would be The Ark Rescue (and thence onward ultimately to privatisation). The report on the final inspection, now postponed, would have provided the climactic instalment.

There are some, however, who are sceptical about the official reasons given for the cancellation of the inspection and support their case by reference to the tone of fevered over-excitement in the last report in March  ( ‘We can see hope now.’ This new-found optimism is palpable!’ etc). These sceptics contend that this March report in fact read more like the climax (‘richer quality of learning…yes!…rigour…yes!…challenge…yes!…more this, more that…...yes yes!…  more rigour still….   yes yes!….best practice…yes yes yes!………..cutting edge……more more more! …….yes yes yes! …ooooohhh ……’ etc)   and that the inspectors reached this climax too early. In a kind of Ofsted premature ejaculation they came too soon to what they should have delayed until later, ie the final triumphant inspection report written to justify the whole year’s evisceration of the school, its curriculum, its staff and its soul. The inability to defer gratification left Ofsted with nothing left in the tank for the final report, hence the cancellation.

The rumour surrounding this theory now joins a litany of other half-believed stories which have circulated in recent months at the school. Here’s a sample.

Rumour 1.    Subject: No Ofsted Inspection (Alternative explanation 1)

According to this one, after the Trojan Horse fiasco, nobody believes Ofsted anymore and Copland’s new owners, Ark,  didn’t want their new property tainted by association. Ark wide-boy and Tory party contributor Lord Fink had a word with Cameron who told Gove, ‘No inspection or I’ll unleash Theresa May on you and you stay on the naughty step for another month’.   ‘Sorted, Dave’, was apparently Gove’s reply.

Rumour 2.     Subject: New School House Names

Apparently, the Ark functionary who decided to impose the name Harold M.Elvin Academy on the new school is determined to continue this theme in other areas. Accordingly, the new school house names are to be similarly influenced by stars of 1970s Philly Soul and will be called

Delphonics, Stylistics, O’Jays, Spinners, Trammps, Sweet Sensations

Plans to change the boys’ school uniform to wide-lapelled velvet jackets, flares and platform shoes with contrast laces and to adopt ‘Betcha By Golly Wow’ as the school motto were considered a step too far, however.  

 (The proposal for ‘Backstabbers’ to be the Leadership Team Motivational Song for the new Ark era was nevertheless accepted unanimously).

Rumour 3.   Subject: No Ofsted Inspection (Alternative Explanation 2) 
 
This rumour claimed that the final Ofsted inspection would, in fact, still take place and it would be on Thursday 10th July when almost all the staff would be on strike and the school would be closed to students. An inspection of an empty school would achieve 2 objectives. Firstly, the incidence of pupil misbehaviour would be substantially less. (The March Ofsted report’s claims that ‘behaviour is much improved and the school is a more respectful place…’  were laughed at by staff who know the reality. ‘The worst it’s ever been’ was what I was told by one experienced teacher in a position to know and with no axe to grind. Hardly surprising when support staff, student supervisors and an entire mentoring department have been scrapped this year and the remaining hard-pressed staff regularly receive messages asking them to help out ‘as we are rather understaffed today’. No kidding!).

The second reason to visit on a strike day would be so that the HMI could see at first hand one great growth area at Copland which is a direct result of the IEB/Marshall regime. Up until last September Copland’s annual loss of teaching days through strike action averaged less than 1 day per year. This year, since the imposition of IEB/Marshall, that figure has improved by about 800% year on year. Having shot their bolt over teaching and learning standards in the March report, Ofsted could have at last begun to retumesce on this one great sign of progress. ( ‘We can see solidarity now. The new-found disillusionment and militancy is palpable!’). It would have made enjoyable reading.

Copland will close next Wednesday and that’s not a rumour. None of the staff forced out over the last year have received any kind of recognition from IEB/Marshall: no leaving ceremonies, no presentations, no collections, no leaving speeches, no spoken thanks, no written communications of gratitude for their contribution. Nothing. Instead, those taking ‘voluntary’ redundancy have received a letter which begins with the sensitive formulation: ‘I write to confirm your dismissal from the services of the school on the grounds of redundancy’.

In a way this is a fitting end to a decline which began with Ofsted failing Alan Davies’s Copland on Safeguarding. (Failing to safeguard the students, that is, not the public funds in the school budget. Ofsted had been quite happy with Davies/Evans/Patel’s financial management of the school, as had Brent Council. It was the staff who blew the whistle on the £2.7 million scam and the staff who suffered the consequences: a series of clueless appointments at senior management level (with new managers primed by Brent to regard the staff as ‘the problem’), and a refusal by Brent either to pursue the missing money or to balance this refusal by acknowledging its responsibility for the resulting budget deficit).

So it goes. For the moment, the city boys, the privatisers, the self-seeking ‘non-political’ careerists and the bullshitters are in the ascendancy. Schools as exam-grade factories will dominate for a while. But they’re only a manifestation of a particular point on the greater narrative arc of our society. If Copland’s teachers have achieved anything in the school’s varied and mostly honourable history it will have been to have helped produce kids who will grow into adults who will appreciate the limitations of this essentially sterile ‘vision’ and  come together to do something positive to change it. 

I wonder where that would feature in an Ofsted inspector’s checklist of teacher achievements.

ARK intransigence provokes Copland strike over compulsory redundancies

The teaching unions (NUT, NAUWT, ATL at Copland Community School have sent the following notice. Copland is due to be forced to be academised and taken over by Ark later this year.


The three teacher unions at Copland Community School in Wembley will be taking strike action again this Wednesday over threatened compulsory redundancies. Two teachers face losing their jobs. The current Headteacher, Richard Marshall and the Unions have been meeting on a weekly basis with the joint aim of preventing this occurring. These negotiations have significantly reduced the original number of proposed compulsory redundancies as well as agreed very useful proposals on how to prevent the loss of the remaining two jobs. These include covering a maternity leave and extending the deadline for compulsory redundancies until December. It is well documented that there is a turn over of staff when a school converts to an academy.

But ARK, who are seeking to take over the school in September, have refused to
agree to any of these proposals.

ARK, known for their anti union stance, are prepared to see the school closed rather than negotiate, are prepared to see the pupils education disrupted. The teachers will be on the picket line again on Wednesday from 7.30 am showing their collective anger at this stance.

Tom Stone, NASUWT Secretary said, “I find the intransigence of the ARK management in not agreeing any of these eminently sensible proposals, unbelievable. We have had weekly meeting with the aim of preventing any redundancies. ARK is prepared to disrupt the children's education when such a small step would solve this situation.

Hank Roberts, ATL said, “If ARK do take over the running of the school in the autumn this does not bode well for the staff or pupils. The children's education has already suffered too much without sacking their teachers.”

Lesley Gouldbourne, NUT said, “We have been working so hard to prevent any strike action. Yet even when we and the school come up with an effective proposal, ARK refuses to agree. It is outrageous that this is allowed to happen when they are not even running the school.”

The teachers are planning to strike again on May 21st if there is not agreement to prevent these compulsory redundancies.

Will breathing be allowed in Birbalsingh's primary school?


The editor cut my reference to"almost 'no breathing'  allowed"  in the letter published on April 10th  in the Kilburn Times (see below) about Katharine Birbalsingh's Michaela Free School. Maybe she was not familiar with Michael Rosen's wonderful poem.

I was trying to make a point about Birbalsingh's strictures on 'installing (sic) impeccable behaviour', children sitting in rows, traditional education and her rejection of any idea that teachers facilitated learning. She has a model of 'private education' which is very old fashioned and out of touch with the real private schools that I come across.

The comments were about her secondary school, which is yet to open, but this week she was on the front page of the Kilburn Times trying to gather support for her bid to open a primary school to feed into Michaela and again, getting the word right this time, of her determination to 'instil impeccable behaviour in pupils while offering a non nonsense approach to learning which will deliver a private standard of education'.

Birbalsingh was quoted as saying, 'We need to show the Department for Education that our primary school will be as popular as our secondary school'. In fact Michaela has been struggling to fill its Year 7 and resorted to advertising in local chicken shops. Its public meetings for potential parents were very poorly attended. As reported here some parents allocated the school by the Council have turned down the offer. Nationally 70% of free school have unfilled places after being open for two years.

As a former primary teacher I shiver at the thought of her 'strict' educational philosophy being imposed on primary aged children.

Birbalsingh says she is seeking parents 'with a professional background' to get involved in her bid. I hope that before doing so they thoroughly research Katharine Birbalsingh's controversial professional background. This includes losing her deputy headteacher job when she used photographs of children at her then school to castigate the comprehensive school system at a Tory Party fringe meetiing and her free school bid being opposed by two other London boroughs.

In the Wembley Ploan space has been earmarked for a new primary school  close to Arena House and North End Road in the Wembley Regeneration area on land which is currently occupied by small industrial and commercial units. Originally this would have been a local authority primary school funded by Section 106 funds as a result of Quintain's redevelopment of the area and the new housing planned.

Meanwhile plans have been approved for a new four form entry primary unit in the grounds of Wembley High School, a new primary unit has opened at Preston Manor High School and additional classes provided  at Preston Park Primary and Park Lane Primary. Ark Academy across the road from Arena House includes a primary department.

Copland land deal for rebuild and academisation

The Brent Executive on April 22nd LINK will discuss a land deal for the Copland Community School site and adjacent lands. Copland is due to become the Ark Elvin academy on September 1st 2014. Government money has been made available for a rebuild which also involves adding another form of entry.   Copland has suffered from an inadequate building for a long time and this has been mentioned in its Ofsted reports.

The previous headteacher Sir Alan Davies and the governing body had plans for redevelopment approved in 2006 which included the 'Copland Village' but these plans were never realised.  The land involved is currently in multi-ownership:

The Council intends to hand the land over to Ark on a 125 year lease and at the same time secure land for the necessary playspace and land for the expansion of Elsley Primary school which will double in size from two forms of entry to four. Current consultation on Elsley's expansion has been halted until the land issue is resolved.

The report states:


Copand Community School is a foundation school and therefore the land and buildings are mainly in the ownership of the school itself, the responsibility for which is vested in the Interim Executive Boards. The IEB has expressed agreement to transfer the freehold of the site which it currently owns to the Council instead, in order for the Council to rationalise the ownership and use of the site overall, ensuring an optimum footprint for the school. The ARK would under these proposals be granted a 125 year lease on the final school site.

 As part of these transactions, the Council would secure enough land from the overall site to facilitate the proposed expansion of Elsley Primary School.

On completion of the freehold transfer the Council will grant the ARK an interim lease agreement to allow occupation of the existing school building until the new building is completed. Following this a 125 year lease arrangement will be granted. The transfer from the IEB needs to happen before the conversion to Academy Status, because the IEB will cease to exist on the conversion date, proposed for 1st September.

The land transaction proposals in the report are dependent on the Secretary of State for Education agreeing to disposal of education land, and specific consent surrounding disposal of school playing fields, this is an absolutely critical point referred to further in section 6 below and the confidential appendix 1.
Section 6 outlines how school playing field disposal has to be approved by the Secretary of State. Because most of the appendices have been declared confidential it is not easy to see just how much of the playing fields will be needed for the new build. There will have to be a statutory  consultation:


Therefore, prior to any disposal or change of use of school land the relevant statutory process will need to be followed. The relevant statutory process that applies will depend upon who owns the said land (for example a governing body of a school, or local authority), and whether the land is playing field land, or non-playing field land. Each process for consent and/or notification has its own specific requirements and complexities.
The scheme would involve commercial development and housing on the present Wembley High road site of the school realising the Wembley Plan's vision of a shopping street from Wembley Central Station to the London Designer Outlet close to Wembley Stadium. The amount of housing and the proportion of it that will be affordable is not stated in the public documentation.
